INTELLECTUAL PROPERTY PROTECTION POLICY
At Rhymart, we respect the creative and proprietary rights of individuals and businesses. Our platform is built on trust, and we take intellectual property protection seriously. This policy describes our approach to handling IP concerns, the process for submitting complaints, and the rights of all parties involved.
What we protect: Patents, trademarks, copyrights, trade dress, and all other intellectual property rights recognized under applicable law.
1. Who Can File an IP Complaint?
You may file an intellectual property complaint if you are:
- The original creator or owner of the protected work
- A legal representative acting on behalf of the rights holder
- An agency or organization with documented authorization to protect the IP in question
Our commitment: Every complaint we receive will be reviewed carefully. We expect all submissions to be truthful and made with honest intent.
2. How to Submit Your Complaint
Step 1: Access Our IP Protection Center Log into your Rhymart account and navigate to our IP Protection Center (available in your account dashboard).
Step 2: Provide Complete Details
Your submission should contain:
About Your Protected Work:
- Clear description of what you own (product design, brand name, creative content, etc.)
- Official registration details, if applicable (trademark number, copyright registration, patent ID)
- Documentation proving ownership (certificates, registration papers, original files)
- Date when your work was first created or used commercially
About the Violation:
- Where the infringement appears (product images, descriptions, titles, actual items)
- Direct links to the problematic listings
- Username or store name of the alleged infringer
- Screenshots or visual evidence of the violation
About You:
- Full legal name
- Business name (if applicable)
- Complete mailing address
- Working phone number
- Email for correspondence
Step 3: Verify Your Claim You'll need to confirm that:
- Your complaint is based on facts you believe to be true
- You understand that false claims may have legal consequences
- You're acting in good faith to protect legitimate rights
Important: We may ask for additional proof before taking action. Incomplete submissions may delay the review process.
3. Special Process for Copyright Claims
Copyright holders have specific legal protections. If you're reporting copyright violation, your notice must include:
- Your authority: Proof that you own the copyright or represent the owner
- What's protected: Description of your original creative work (text, images, videos, designs, etc.)
- What's being copied: Specific identification of the unauthorized copies on our platform
- How to reach you: Valid contact information for follow-up
- Your declaration: A sworn statement that:
- You genuinely believe the use is unauthorized
- The information you've provided is accurate
- You accept responsibility for false statements
Warning: Making intentionally false copyright claims can result in legal liability. If you're uncertain about your rights, consult an attorney before proceeding.
What happens next:
- Valid claims result in immediate content removal
- We notify the affected seller
- Serious or repeated violations may lead to account termination
- We maintain confidentiality about enforcement actions
4. If Your Content Was Removed: Filing a Dispute
Did we remove your listing based on an IP complaint? You have the right to dispute if you believe:
- The complaint was incorrect or mistaken
- You have legal permission to use the content
- Your use falls under fair use or other legal exceptions
To file a dispute, submit:
- A clear explanation of why the removal was wrong
- Evidence supporting your right to use the content (licenses, permissions, proof of ownership)
- Any documentation required by law in your jurisdiction
We'll review your dispute and respond according to legal requirements.
5. Canceling Your Complaint
Changed your mind? You can withdraw your IP complaint through the IP Protection Center.
You'll need to specify:
- Your original complaint reference number
- The exact listings or content you want to release from the complaint
- Confirmation that you're withdrawing voluntarily
6. Our Standards for Honest Reporting
We don't tolerate abuse of this system.
Complaints that appear fraudulent, exaggerated, or malicious will be rejected. This includes:
- Claims without proper evidence
- Reports made to harm competitors unfairly
- Bulk complaints submitted carelessly
- Repeated false allegations
Consequences for misuse:
- Loss of access to our IP Protection Center
- Possible account restrictions
- We may report serious abuse to relevant authorities
7. Protecting Our Community
For Rights Holders: We're your partner in protecting what you've created. Report violations promptly and provide thorough documentation.
For Sellers: Only list products you have the right to sell. Respect others' intellectual property just as you'd want yours respected.
Our Role: We act as a neutral platform. When we receive valid complaints, we must respond. Our decisions are based on the information provided by both parties.
